1. About EmoTalks
EmoTalks is an AI-powered social platform operated by EmoTalks, Inc., a company incorporated in the United States. The platform helps people express themselves authentically, discover resonant perspectives, and build meaningful connections through AI-driven emotional intelligence.
2. Eligibility
You must be at least 13 years old (or 16 in the EU/EEA) to use EmoTalks. By creating an account, you confirm you meet the minimum age requirement in your jurisdiction. EmoTalks is not available to users who have previously been banned from the platform.
3. Your Account
- You are responsible for maintaining the security of your account credentials
- You must not share your account with or transfer it to another person
- You must notify us immediately at security@emotalks.com if you suspect unauthorised access
- You may delete your account at any time from account settings
4. Acceptable Use
You agree not to use EmoTalks to:
- Post content that is illegal, defamatory, threatening, or harassing
- Impersonate any person or organisation
- Distribute spam, malware, or phishing content
- Scrape, crawl, or harvest data from the platform without written permission
- Attempt to reverse-engineer or circumvent the AI recommendation system
- Create accounts using automated means (bots)
- Manipulate EmoPoints through artificial engagement or coordinated inauthentic behaviour
- Post content that sexualises minors or facilitates their exploitation
- Promote or facilitate gambling, wagering, or games of chance
5. Content & Intellectual Property
5.1 Your Content
You retain ownership of the content you post on EmoTalks. By posting, you grant EmoTalks a worldwide, non-exclusive, royalty-free licence to display, distribute, and process your content for the purpose of operating and improving the platform, including AI model inference for matching and content ranking.
5.2 EmoTalks IP
The EmoTalks platform, brand, AI models, and all associated technology are the exclusive property of EmoTalks, Inc. You may not copy, modify, or distribute them without our prior written consent.
6. EmoPoints
EmoPoints are a non-monetary social credibility metric awarded by community resonance. They have no cash value, cannot be exchanged for money or cryptocurrency, and are not transferable between accounts. EmoTalks reserves the right to adjust or reset EmoPoints at any time to maintain platform integrity.
7. AI Features
EmoTalks uses large language models and vector embedding technology to power content ranking, emotional resonance detection, and user matching. AI-generated recommendations are probabilistic and not guaranteed to be accurate. You should exercise your own judgement when acting on AI-driven connection suggestions.
8. Moderation & Enforcement
EmoTalks reserves the right to remove content, suspend, or permanently ban accounts that violate these Terms, without prior notice in cases of serious violations. We operate a tiered enforcement system: warnings for minor breaches, temporary suspension for repeated breaches, and permanent ban for severe violations.
To appeal a moderation decision, contact appeals@emotalks.com within 30 days.
9. Disclaimer of Warranties
EmoTalks is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that AI matching will produce any particular result.
10. Limitation of Liability
To the maximum extent permitted by applicable law, EmoTalks, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total aggregate liability shall not exceed the greater of USD $100 or the amount you paid us in the past 12 months.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the AAA Consumer Arbitration Rules, except that either party may bring claims in small claims court.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days in advance. Continued use of EmoTalks after changes take effect constitutes acceptance of the revised Terms.
